Article 1. Purpose

These terms and conditions are Enviro Korea Co., Ltd. Internet related services provided by Enviro Korea Mall (hereinafter referred to as the "mall") operated by the company (e-commerce provider) (hereinafter referred to as "service") The purpose of this article is to define the rights, obligations and responsibilities of the cyber mall and users.

Article 2. Definition
  1. "Mall" is a virtual setting that allows Enviro Korea Co., Ltd. to trade goods and other goods using information and communication equipment such as computers in order to provide goods or services (hereinafter referred to as "goods") to users. It refers to the business location of the company, and is also used as a business operator operating a cyber mall.
  2. “User” refers to members and non-members who access the “Mall” and receive the services provided by the “Mall” according to these terms and conditions.
  3. “Member” refers to a person who has registered as a member by providing personal information to the “Mall”, who continuously receives the information of the “Mall” and can continuously use the services provided by the “Mall”.
  4. “Non-member” refers to a person who does not join a member and uses the services provided by the “Mall”.
Article 3. Specification and Revision
  1. "Mall" is the initial service of Enviro Korea Co., Ltd. so that users can know the contents of this agreement and the company name, business location, representative's name, business registration number, and contact information (telephone, fax, e-mail address, etc.) Post it on the screen (front).
  2. The “Mall” may revise these terms and conditions to the extent that they do not violate the laws related to the regulation of the terms, the Basic Act on Electronic Transactions, the Electronic Signature Act, the Act on Promotion of Information and Communication Network Utilization, the Act on Visiting Sales, and the Consumer Protection Act.
  3. When the “Mall” revises the terms and conditions, the date of application and the reason for the revision are specified, and the current terms and conditions are notified on the initial screen of the mall from 7 days before the application date to the day before the application date.
  4. When the “Mall” revises the terms and conditions, the revised terms and conditions apply only to the contract concluded after the effective date, and the terms and conditions of the pre-revision terms are applied to the contracts already concluded before that. However, if the user who has already signed the contract wants to be subject to the provisions of the revised terms and conditions, the provisions of the revised terms and conditions will be applied if the consent of the “mall” is received by sending it to the “mall” within the notice period of the revised terms and conditions under paragraph 3.   5. Matters not specified in these Terms and Conditions and interpretation of these Terms shall be in accordance with the e-commerce consumer protection guidelines and related laws or commercial regulations established by the government.
Article 4. Provision and change of service
  1. The "Mall" performs the following tasks.
    1. Provision of information on goods or services and conclusion of purchase contract
    2. Delivery of goods or services with a purchase contract
    3. Other "Mall" duties
  2. "Mall" may change the content of goods or services to be provided by a contract to be concluded in the event of a sellout of goods or services or a change in technical specifications. In this case, the contents and date of delivery of the changed goods or services are specified, and the current goods or services are posted immediately.
  3. When the contents of the service contracted with the user to be provided by the "Mall" is changed for reasons such as out of stock, such as goods, or changes in technical specifications, the reason is immediately notified to the address that can notify the user.
  4. In the case of the preceding paragraph, the "Mall" compensates the user for the damages. However, this is not the case when the "Mall" proves that there is no intention or negligence.
Article 5. suspension of service
  1. The “Mall” may temporarily suspend the provision of services in the event of reasons such as maintenance and inspection, replacement and failure of information and communication facilities such as computers, and loss of communication.
  2. In the case of service interruption pursuant to paragraph 1, the “Mall” will notify the user in the manner specified in Article 8.
  3. The “Mall” compensates for damages suffered by the user or a third party due to the temporary suspension of service provision for the reason of paragraph 1. However, this is not the case if there is no intention or negligence in the “Mall”.
Article 6. Membership
  1. The user applies for membership by filling in the member information according to the registration form set by the “Mall” and expressing his intention to agree to these terms.
  2. The “Mall” registers as a member, unless it falls under any of the following subparagraphs among users who have applied for membership as in paragraph 1.
    1. If the applicant for membership has previously lost membership under Article 7 (3) of these Terms and Conditions, but has passed the membership qualification under Article 7 (3) 3 years after obtaining the membership approval of the "Mall" In the case of exception.
    2. If there is false information, omission, or error in registration contents
    3. If it is judged that registration as other member is significantly impeded by the “mall”
  3. The time of establishment of the membership subscription agreement is when the acceptance of the “Mall” reaches the member.
  4. If there is a change in the registration information pursuant to Article 15 (1), the member must immediately notify the "Mall" of the change by e-mail or other method.
Article 7. Member withdrawal and disqualification, etc.
  1. Members can request the withdrawal at any time to the "Mall", and the "Mall" will immediately withdraw membership.
  2. If the member falls under any of the following reasons, "Mall" may limit and suspend membership.
    1. When false information is registered at the time of application
    2. In the event that the member's debts related to the payment of goods purchased using the “Mall” or other use of the “Mall” are not paid on a due date
    3. Threatening e-commerce order, such as interfering with the use of other people's "mall" or stealing the information
    4. If you use the "Mall" to act against the law or this agreement or contrary to public order and morals
  3. After the “Mall” restricts or suspends membership, the “Mall” may lose membership if the same act is repeated more than once or the reason is not corrected within 30 days.
  4. If the "Mall" loses membership, the membership registration will be cancelled. In this case, the member is notified of this, and a period of at least 30 days prior to the cancellation of membership registration is given to give an opportunity to call.
Article 8. Notice to Members
  1. If the "Mall" notifies the member, the member can make an e-mail address specified in advance with the "Mall".
  2. "Mall" can replace individual notices by posting on the "Mall" bulletin board for more than one week in the case of notice to unspecified members. However, individual notices are given for matters that have a significant impact on the member's transaction.
Article 9. Purchase Application
  1. “Mall” users apply for purchase on the “Mall” by the following methods.
    1. Enter name, address and phone number
    2. Selection of goods or services
    3. Choice of payment method
    4. Indication of acceptance of these terms (e.g. mouse click)
Article 10. Establishment of contract
  1. "Mall" may not approve the purchase request as in Article 9 if it falls under any of the following subparagraphs: However, when signing a contract with a minor, if you do not obtain the consent of the legal representative, you must notify that the minor or the legal representative may cancel the contract.
    1. If there is false information, omission, or error in the content of the application
    2. When a minor purchases goods and services prohibited by the Youth Protection Act, such as tobacco and alcohol.
    3. If it is judged that accepting the purchase request is significantly impeded by the "mall" technology
  2. It is assumed that the contract is established when the acceptance of the "Mall" reaches the user in the form of an acknowledgment notice in Article 12 (1).
  3. The "Mall"'s intention to approve must include information about the user's purchase application confirmation and availability, and cancellation of the purchase application.
Article 11. Payment Method
  1. The payment method for goods or services purchased in the “Mall” may be one of the following:
    1. Bank Transfer
    2. Credit card payment
    3. Online passbook deposit
    4. Payment by electronic money
    5. Payment upon receipt, etc.
Article 12. Notice of receipt confirmation, change and cancellation of purchase application
  1. "Mall" notifies the user of the receipt if there is a purchase request from the user.
  2. In the event of a discrepancy in the intention to display, a user who has received a confirmation of receipt may request to change or cancel the purchase application immediately after receiving the confirmation of receipt.
  3. "Mall" will process the request for change or cancellation of the user's purchase request before delivery without delay.
Article 13. Delivery
  1. “Mall” specifies the delivery method, the delivery cost bearer for each method, and the delivery period for each method for goods purchased by the user. If the agreed delivery period is exceeded due to the intention or negligence of the “Mall”, the user's damages will be compensated.
Article 14. Refunds, Returns and Exchanges
  1. “Mall” notifies the user of the reason without delay if the goods or services that the user has applied for purchase cannot deliver or provide goods for reasons such as out of stock, and if the goods or services are received in advance In 3 days from the date the payment is received, otherwise, the contract cancellation and refund procedure is performed within 3 days from the date of occurrence.
  2. In the case of each of the following items, even if the goods are delivered, the goods will be returned, returned, or exchanged immediately upon receipt of the request within the business day after the goods are returned. However, the deadline is 20 days from the date of delivery.
    1. When the delivered goods are different from the order contents or the information provided by the “Mall”
    2. When the delivered goods are damaged, damaged or contaminated
    3. The goods are delivered later than the delivery period indicated in the advertisement.
    4. In the event that the user's subscription is made without displaying the items to be displayed in the advertisement in accordance with Article 18 of the Act on Visiting Sales, etc.
Article 15. Protection of personal information
  1. “Mall” collects the minimum information necessary to fulfill the purchase contract when collecting user information.
    The following items are required and others are optional.

    4. Desired ID (for members)
    5. Password (for members)
  2. When the “Mall” collects personal information that can be personally identified by the user, the user must obtain the consent of the user.
  3. The personal information provided cannot be used for any purpose other than the user's consent or provided to a third party, and all responsibility for this is the “mall”. However, with the exception of the following cases.
    1. In the event of delivery, if the minimum information required for delivery (name, address, phone number) is provided to the delivery company

  4. When the “Mall” must obtain the user's consent pursuant to paragraphs 2 and 3, the identity of the person in charge of personal information management (affiliation, name and phone number, other contact information), the purpose of collecting and using the information, and the third party The provisions of Article 16, Paragraph 3 of the Act on Promotion of Utilization of Information and Communication Networks, such as matters related to information provision (recipients, purpose of provision, and contents of information to be provided) must be specified or announced in advance, and the user may withdraw this consent at any time. can.
  5. Users can always request to read and correct errors in their personal information that the “Mall” has, and the “Mall” is obliged to take necessary measures without delay. If the user requests to correct the error, the “Mall” will not use the personal information until the error is corrected.
  6. The “Mall” limits the number of administrators to protect personal information, and minimizes the number and takes full responsibility for the user's damages due to loss, theft, leakage, and alteration of the user's personal information, including credit cards and bank accounts. .
  7. When the “Mall” or a third party who has received personal information from it has achieved the purpose of collecting or receiving personal information, the personal information is destroyed without delay.
Article 16. Obligations of the “Mall”
  1. “The Mall shall not do anything that is prohibited by the law and this Agreement or contrary to public order and morals, and must do its best to provide goods and services consistently and stably as prescribed by this Agreement.
  2. The "Mall" must have a security system to protect the user's personal information (including credit information) so that the user can safely use the Internet service.
  3. The “Mall” is responsible for reimbursing the user for any damages caused by the user's damages by performing unlawful indications and advertisements prescribed in Article 3 of the 「Act on Fairness of Labeling and Advertising」 for products and services.
  4. "Mall" does not send commercial e-mail for commercial purposes that users do not want.
Article 17 Member's ID and password obligations
  1. Except in the case of Article 15, the member is responsible for managing ID and password.
  2. Members should not allow third parties to use their ID and password.
  3. If a member knows that his ID and password are stolen or is being used by a third party, he must notify the "mall" immediately and follow the "mall" instructions.
Article 18. User obligations
The user should not conduct the following.
  1. Registration of false information when applying or changing
  2. Changes to information posted on the “Mall”
  3. Send or post information (computer programs, etc.) other than the information specified by the “Mall”
  4. Infringement of intellectual property rights such as copyrights of the "Mall" and other third parties
  5. Any act that damages the reputation of the “Mall” or other third parties or interferes with business
  6. Disclosing or posting obscene or violent messages, images, voices, or other information contrary to public order and morals
Article 19. The relationship between the linked "mall" and the linked "mall"
  1. If the upper “mall” and the lower “mall” are linked in a hyperlink (eg, the target of the hyperlink includes text, pictures, and moving images), etc., the former is called the linking “mall” (website), and the latter is avoided. This is called the connection “mall” (website).
  2. Linked "Mall" means that the linked "Mall" does not assume the responsibility for guarantees for transactions conducted with users by the goods and services provided by the linked "Mall". Do not lose.
Article 20. Attribution of copyright and restrictions on use
  1. Copyright and other intellectual property rights to works created by the "Mall" belong to the "Mall".
  2. Users shall not use the information obtained by using the “Mall” for commercial purposes or to make it available to third parties by reproduction, transmission, publication, distribution, broadcasting, or other methods without prior consent of the “Mall”.
Article 21. Dispute Resolution
  1. The “Mall” installs and operates a damage compensation mechanism to reflect the legitimate opinions or complaints raised by users and to compensate for the damage.
  2. "Mall" handles complaints and opinions submitted by users with priority. However, if prompt processing is difficult, the user will be immediately notified of the reason and schedule.
  3. Disputes between the “Mall” and users may be subject to the mediation of the Electronic Transaction Dispute Mediation Committee established under Article 28 of the Framework Act on Electronic Transactions and Article 15 of the Enforcement Decree.
Article 22. Jurisdiction and Governing Law
  1. Lawsuits regarding electronic transaction disputes between the “Mall” and users are brought to the competent court under the Civil Procedure Act.
  2. Korean law applies to e-commerce lawsuits filed between the “Mall” and users.
